FreeWills.co.uk is a service and website owned and operated by Quick Will Ltd, a company registered in England and Wales, under company registration number 10839104 with a registered address of 42a Arena Business Centre, 9 Nimrod Way, Wimborne BH21 7UH. Your use of this website ("the website") is governed by these terms and conditions (“terms”).  By visiting and using this website, you automatically agree to these Terms and Conditions in their entirety.

1. Registration

1.1 To order any documents from our website, you will need to register your details with us.
1.2 You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of registration and that you do not provide false or misleading details. Where requested, you must provide us with valid and complete contact details. We accept no responsibility for verifying any of the above or your identity.
1.3 When registering with us you will be required to provide a valid email address and password of your choosing. You must ensure that you keep these details secure and do not provide this information to a third party. We will not be liable for any unauthorised access by a third party using your email address and password. In the event you suspect your account security has been compromised, including unauthorised use of your email address and password, you must notify us immediately via email. We will provide timely assistance to secure your account, which may include resetting your password and reviewing recent account activity. We will take reasonable steps to verify your identity before making any changes to your account or providing access to your account information.
1.4 You must be aged 18 years or over to order any documents from us.
1.5 You must understand the English language, and that you understand the nature and purpose of making a Will, the extent of your estate and that you are aware of and have considered everyone that might reasonably be expected to be provided for by your Will.
1.6 You must be acting of your own free will and not subject to any coercion or any undue influence.
1.7 Our acceptance of your order for documents via this website will take place at the time when we process your order, at which point a contract will come into existence between you and us.
1.8 You agree that if you do not comply with the above rules then we are under no obligation to provide you with any documents and the agreement will be void and as if it had never been made. In this situation, you agree that you will not be able to hold us to any obligations under these terms and conditions or to sue us if those terms and conditions are breached.

2. Documents

2.1 Any documents downloaded from the website are intended for your use only and you warrant that any documents ordered by you are not for resale and that you are acting as principal only and not as an agent for another party. We shall not be liable for documents for any third party.
2.2 You are permitted to make certain modifications to the documents you have ordered to ensure they accurately reflect your wishes and circumstances. However, for the integrity and security of the document, changes to the primary identifier, such as the name of the document holder, are not allowed once the document is created. This measure is in place to prevent fraudulent misuse of our services. Should you need to correct or update your name due to legal changes or errors, please contact us for assistance. We are committed to helping you maintain accurate and secure documents.
2.3 Where you have elected for a digital copy of the documents only, we will make that digital content available for download by you as soon as we accept your order. Where you have elected for a printed copy of the document, we will endeavour to post the document to you within five working days.
2.4 Any printed documents will be posted to the address nominated by you on the website. We will not be held liable for documents mis-delivered or mislaid in the post.
2.5 Where you provide information about another person or third party, you confirm that you have their permission to provide us with their details and for it to be used in the preparation of any documents.

3. Payments

3.1 If applicable, the total price (inclusive of VAT) for any upgrades available will be displayed on the website and indicated on the order pages when you place your order.
3.2 If there is an obvious and unmistakeable pricing error, we are under no obligation to provide the product or service to you at an incorrect price. We reserve the right to bring such an error to your attention and you agree that in these circumstances, you will be liable to pay the full and proper price as it would have been if there had not been a pricing error.
3.3 All sales made through this website are generally final. We do not offer refunds or exchanges for any products or services purchased unless there are exceptional circumstances. In cases where a product is found to be significantly not as described, or if there are technical issues preventing the proper use of our product that cannot be resolved with our support team's assistance, we may, at our discretion, consider issuing a refund or providing a credit for future use. To request a refund under these exceptional circumstances, please contact us within 14 days with a detailed explanation of the issue. We reserve the right to verify the claim before processing any refund requests.

4. Cancellation

4.1 Documents generated through this website are electronic in nature and therefore you cannot cancel once you have placed an order. This is in accordance with the Office of Fair Trading Distance Selling Regulations. We provide a 14-day cooling-off period for cancellations, applicable only before document customisation or download begins. To cancel within this period, please contact us directly. This right is void once any customisation or download occurs.
4.2 Due to the bespoke nature of the documents being created, you are not entitled to cancel your order or to return the documents unless either (i) the file cannot be opened or is corrupted when you try to open the document; or (ii) any printed version of the document ordered is unreadable upon receipt.
4.3 We reserve the right to refuse to process any documents at our absolute discretion.
4.4 We may cancel or suspend your access to the documents and/or website if we consider that you have acted in breach of any of these terms.

5. Your Data

5.1 Where we have requested data from you to provide the documents, you agree to provide us with accurate and complete information. It is your responsibility to provide us with accurate information and to ensure that your information is current and up to date. We make no assurances, guarantees or warranties as to the legality or effectiveness of the information you provide or the choice of words that you use. You agree that you will not hold us liable, and that it will be an absolute defence for us to any claim you bring against us, if the information you have entered is incorrect and as a result of this you (or a person you intended to gain a benefit from your Will) do not gain such a benefit or otherwise suffer a loss.
5.2 You agree not to hold us liable if you provide us with an address or email address that is not correct and, as a result of this, do not receive a notification or document from us that you otherwise would have received if your information had been current and up to date.
5.3 Where we have requested data from you to provide the documents, you agree to provide us with accurate and complete information.
5.4 We have taken all reasonable steps to prevent fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the event of a breach in our secure computer servers or those of third parties.
5.5 We take all reasonable care, in so far as it is in our power to do so, to keep the details of your order secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data which you provide when accessing the website.
5.6 We will use the personal information you provide to us: a) to supply the document to you; b) to process your payment for the documents where applicable; and c) to give you information about similar products that we and others provide, but you may choose to stop receiving this at any time by contacting us.
5.7 We will only give your personal information to third parties where the law either requires or allows us to do so.

We retain ownership of all intellectual property rights related to the website, including software, graphics, copyrights, trademarks and other proprietary rights. No licence is granted to you to use any such intellectual property save that you are permitted to use the website in accordance with these terms. You must not modify, copy, reproduce, upload, post, transmit or distribute by any means or in any manner whatsoever, any material or document downloaded from our website except where expressly invited to do so or indicated on our website.
6.3 You are granted a non-exclusive, non-transferable licence by us to use our website and to print pages from the website. If you order a document through the website you will be granted permission to download your document.
6.4 You shall not license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the documents or the content of our website in any way.

Any document produced via this website is used entirely at your own risk and you accept full responsibility should it prove to be unsuitable for your circumstances.

9. Variability

9.3 Any contract made for the documents is between you and us. No other person shall have any rights to enforce any of its terms.
9.4 Each of the clauses of these terms and conditions operates separately. If any court or relevant authority decides that any part of these Terms and Conditions are unlawful, invalid or void, the remaining clauses will remain in full force and effect.
9.5 No delay or failure on our part to enforce our rights or remedies under these terms and conditions shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.

10. Governing Law

10.1 These Terms and Conditions shall be governed by and construed in accordance with English law and the English Courts shall have exclusive jurisdiction to deal with any disputes.
